Typically, to hire a temporary (non-immigrant) worker, the U.S. employer must file a request with USCIS for the foreign worker to come to the United States.

What needs to be done is explained by El Nuevo Herald

1. β€œThe applicant company or the applicant must have a temporary need for the work or services to be provided.

2. As of July 20, 2023, H-2B visas reserved for citizens of El Salvador, Guatemala, Honduras, and Haiti will continue to be available.

3. The petitioner is applying for a DOL Certificate for Foreign Labor Temporary Agency Work, also known as a Foreign Labor Certificate.

4. Before applying for an H-2B Visa classification by USCIS, the petitioner must apply for and receive this employment certification.

5. File a Form I-129 with USCIS.

6. Employees located outside of the United States must apply for a visa and/or admission after the form has been approved by USCIS, a visa applied for with DOS at a U.S. embassy or consulate in your home country.

7. You must then apply for the authorization of admission at a US port of entry or apply for admission to the US in the H-2B classification directly with CBP at a US port of entry.
