A new appeal filed by lateral Daniel Alves was denied this Monday (12) in Barcelona and the player will remain in preventive detention, which he has served since January, accused of rape.
“We refuse the appeal filed by the procedural representation of Daniel Alves da Silva”, wrote the magistrates in their decision published this Monday, again closing the doors for the player to wait for the trial, still without a set date, in freedom. The judges had already turned down another request from the player in February.
After analyzing the new allegations and diligences, the magistrates of the Hearing of Barcelona, the highest instance of Justice in Catalonia, reaffirmed that “the evidence of criminality that we consider sufficient to impute the fact to him and as grounds for the precautionary measure remain unaltered”.
The magistrates did not consider, for example, that the registration of the children of Alves as residents of Barcelona was sufficient to establish a link with the country.
“The risk of flight remains and continues to support the reasons that we have already explained and to which we must obligatorily refer. We consider that no other precautionary measure can contain this risk with sufficient guarantee”, they reinforced.
This new request – which tried to reverse another refusal to release him, pronounced in May by the investigating judge – was again contested both by the Public Prosecutor’s Office and by the prosecution’s assistance.
Daniel, 40, was placed in pretrial detention without bail on January 20 for an alleged crime of sexual assault, which in Spain includes rape. A young woman accuses him of having raped her in the bathroom of a Barcelona nightclub at the end of December.
The athlete’s version, which at the beginning assured that the whistleblower was not known, has already changed several times. In April, he declared to the judge that he had consensual sexual relations with the young woman, which he initially denied in an attempt to hide his infidelity towards his ex-wife.
