Three political trials block UNES, PSC and Pachakutik in their intention to speed up the interpellation of CPCCS members

Three political trials block UNES, PSC and Pachakutik in their intention to speed up the interpellation of CPCCS members

In five political trials that are processed in the National Assembly there is a coincidence: the proponents belong to the ranks of Correismo and the self-proclaimed rebels of the Pachakutik movement who commune with Leonidas Iza, president of the Confederation of Indigenous Nationalities of Ecuador (Conaie).

They all call for the dismissal and censorship of the main authorities of the Superintendency of Banks, the State Comptroller General’s Office, the State Attorney General’s Office, the National Electoral Council (CNE) and the members of the Council for Citizen Participation and Social Control (CPCCS).

But they also agree that the questioning of the members of the CPCCS should be accelerated, without observing the order of priority in which it reached the Legislative Administration Council (CAL). They affirm that this can be done through a resolution of the plenary session of Parliament that obliges the Oversight Commission to process this request before three other political trials that have already been notified by the CAL.

Of this group of officials threatened with interpellation, the request for trial filed by Darwin Pereira (Pachakutik) against the Superintendent of Banks, Ruth Arregui, concluded in the commission with the approval of the report in which the file is recommended, due to the alleged lack of substantiation of the evidence. The file will be known in plenary this February 15.

LThe latest request for impeachment made by Mireya Pazmiño and Ángel Maita, from the Pachakutik rebel group, against the four members of the CPCCS: Hernán Ulloa, María Fernanda Rivadeneira, Francisco Bravo and Ibeth Estupiñán, accused of breach of duties, captures the interest of UNES, PSC and a sector of Pachakutik. And another PK sector presented, on the other hand, this February 14 a request for interpellation to the seven members of the organization.

Despite the fact that the CAL has not yet qualified the interpellation request against the new majority of the CPCCS, these political sectors are already talking about approving a resolution in plenary to declare this trial process as a priority in its processing.

The interest in accelerating this political trial arises after the dismissal of Sofía Almeida and David Rosero as president and vice president of the CPCCS, respectively, by a new majority. The issue is still being elucidated in court as there are legal appeals pending.

The crisis of the Council keeps the public selection contests of 47 officials from ten State institutions paralyzed, among them the comptroller general, the Public Defender’s Office, the People’s Defender’s Office, four members of the National Electoral Council, two judges of the Contentious Electoral Court, superintendent of Companies and members of five national equality councils. Influencing to capture these dignities fuels political confrontation.

Ferdinan Álvarez, from UNES, considers that what happened in the CPCCS violated the democratic principles of the country and warns that the only thing the Government intends is to take state institutions by storm.

He called on the president of the National Assembly, Guadalupe Llori, and the CAL to qualify the impeachment trial against the four CPCCS councilors, and urged the plenary to pronounce itself through a resolution so that this trial is treated in a fair manner. immediate.

The representative of UNES maintained that the 72 signatures that support the trial of the Council can approve a resolution in plenary and order that the impeachment proceed. using attribution as the ultimate agency of interpretation.

Judgment deadlines and notices

But the announcement of the three political sectors to advance the impeachment of the CPPCS was refuted by the president of the Oversight Commission, Fernando Villavicencio, who said that this intention shows “total ignorance” about the inspection processes and confirms the desperation in which they have fallen because they intend to run over the law and the Constitution, since article 81 of the law that governs Parliament shows the procedure.

The rule indicates that if during the process of substantiating an impeachment proceeding the CAL submits a new request, its term for advocating knowledge will run from the end of the one in progress in the Commission. In other words, another case cannot be heard while a previous one is being processed.

yesAccording to the deadlines established by law, each trial takes at least 30 days for its processing, which includes the presentation of evidence for the charge and defense, appearances, presentation of evidence and reports. You can even request an extension of five additional days.

Villavicencio indicated that at the moment three new political trials are registered with the Commission.

First, against the deputy comptroller general, Carlos Riofrío, at the request of legislator Ronny Aleaga (UNES), for alleged breach of duties regarding the previous reports of the control body for public procurement.

In this case, Villavicencio explained that the entire month of February and half of March would be taken; Immediately, when the report is notified to the president of the Assembly, the next trial presented will be known, according to the order of arrival.

The second trial was filed by Álvarez against the attorney general, Íñigo Salvador, accused of breach of duties because, according to the questioner, in two lawsuits against the State, the official limited himself to saying that companies should be paid international. This trial will take from mid-March to mid-April.

The third request that came to the Oversight table, Villavicencio said, was raised by the rebel assembly members of Pachakutik, Joel Abad and Mario Ruiz, and is against CNE members Diana Atamaint, José Cabrera, Esthela Acero and Enrique Pita, and former counselor Luis Verdesoto. This will run from mid-April to mid-May at the earliest.

According to Villavicencio, observing the regulations and the established deadlines, the political trial of four CPCCS councilors would be processed close to the legislative vacancy, in July.

Everything carried out by the UNES, PSC and Pachakutik, according to Villavicencio, is “a shot in the air” and reveals desperation and ignorance of the proceduresThat is why he said that he will give each legislator a law that governs the Legislative Function and will also request that they be given a workshop on legislative and oversight procedure.

“We have three notified processes on the Commission’s agenda, and we cannot change them, and if we do, we would be violating the organic law of the Legislative Branch,” Villavicencio warned. (I)
