The plenary session of the Judicial Council (CJ) declared, this Tuesday morning, the nullity of the decision made by the former president of the organization, María del Carmen Maldonado, who left the suspension against the prosecutor of the province of Manabí, Juan Carlos Izquierdo, who would be related to the case investigating the death of Naomi Arcetales, an event that occurred in early December last.
According to the plenary session of the CJ, the revocation dictated by Maldonado, which became known after resigning from the position of president of the Judiciary, not only lacked motivation, but it was also explained that they had not changed the circumstances that initially generated the suspension. The ratification of Izquierdo’s suspension was taken by the plenary session six days after Maldonado lifted it.

Maldonado resigned from being the head of the CJ last Wednesday, due to differences with a sentence of the Constitutional Court (CC) that removed him from the presidency of that body the power to suspend judicial officials.
The new president of the CJ, Fausto Murillo, stated that in order to make the decision to ratify the suspension of Izquierdo, the respective legal reports were requested from the General Directorate and legal, and treatment of this issue was prioritized at Tuesday’s meeting.
According to the plenary of the CJ, the decision to revoke the former president lacks sufficient motivation, since it simply María del Carmen Maldonado would have indicated that she revokes it because she has presented her resignation from the position of president of the CJ. “That brief motivation given by former President Maldonado, according to the recommendation of the technical area, affects that decision as irremediable nullity,” Murillo said.
