TCE provides that the Electoral Council deliver signature collection forms for the process of revocation of the mandate of the mayor of Paltas and two councilors

This would be the second mandate revocation process in the province of Loja.

The Contentious Electoral Tribunal (TCE) ordered the National Electoral Council (CNE) to deliver the signature collection forms for a possible revocation of the mandate of the mayor of the Paltas canton, within a period of fifteen days. Jorge Luis Feijoó Valarezo, in addition to Francisco José Mora Sanmartín and Yovanna del Carmen Quevedo Serrano, main and alternate councilors of that Lojan town.

In a ruling, signed this October 21 in Quito, the TCE accepted the subjective electoral contentious appeal filed by Julio Dositeo Carrión Ramírez before Resolution PLE-CNE-1-30-8-2021-2 issued by the plenary session of the National Electoral Council in which a request for the delivery of the signature forms for the revocation of the mandate of the authorities of that canton was inadmissible, last August.

In its resolution, the TCE also provides that it proceed in accordance with the provisions of paragraph 4 of article 284 of the Code of Democracy in order for the electoral justice body to guarantee due process, “to determine whether there is the commitment of the electoral infraction contained in article 279 numeral 14 and 280 numeral 20, ibid ”, indicates the document signed this October 21.

In the same document, it is mentioned that the appellant Julio Carrión bases his request on the alleged breach of the work plan and the functions and obligations established in the Constitution and the mayor’s law, and repeats the last cause for the two councilors.

The document presents arguments of the proponent, such as observations on issues related to the definitive drinking water project in the city of Catacocha and the construction, improvement and rehabilitation of the water system in neighborhoods and parishes of the canton, in addition to gender parity in the election of Deputy Mayor José Mora Sanmartín, who replaced Yennifer López. On this last issue, a criminal court ordered López’s reinstatement last August.

Within the case file, it is indicated that in a brief presented by the mayor and the councilors, together with a sponsoring attorney, a response was given to Carrión’s request, which they considered “illegal and unfair” and challenged each of them. their parts and requested the file of the same, in addition they attached documentary evidence.

After collecting the signatures, the process would continue with the plebiscite for the citizens to decide whether or not to revoke the mandate conferred on the mayor and councilors.

This would be the second process of revocation of the mayor’s mandate in that southern province of the country. The first case was carried out in Loja with Bolívar Castillo, who left office in June 2018 after a plebiscite. (I)
