A court of the Provincial Court of Guayas denied the habeas corpus filed by the defense of Daniel Salcedo Bonilla, who is detained for crimes of embezzlement, procedural fraud and entry of prohibited items into jail.
The members of the court unanimously rejected Salcedo’s request, who is in prison in the capital.
In court they considered that the prison has not expired in his case and that the threats through an email are not enough to get him out of prison 4 in Quito.
The case was addressed by judges Fabiola Gallardo, José Poveda and Carlos González.
Days ago, the State Prosecutor’s Office publicly warned that the defenders, through “arguments”, tried to ignore the provisions of the Comprehensive Organic Criminal Code (COIP) regarding preventive detention.
The entity indicated that Salcedo’s lawyers, sentenced in the first instance for embezzlement, procedural fraud and prosecuted for organized crime, have requested the appeal of habeas corpus arguing the expiration of preventive detention in the judicial process for the crime of organized crime, which has not yet been sentenced.

Cristian Romero, the lawyer who is leading the trial of Daniel Salcedo, confirmed to this newspaper that the court rejected the request for habeas corpus and said that he will meet with the family of his client to take the next steps.
“The court considers that the decision is not binding, sentence 2505-19-JH, because for them it is about another case and not the specific case, it is a wrong argument,” Romero said.
The Prosecutor’s Office had warned that it was intended to ignore what is stipulated in the COIP: that the term for the expiration to operate will be counted from the date on which the preventive detention order became effective. Once the sentence is handed down, these deadlines will be interrupted.
Salcedo’s defense made the request for habeas corpus also arguing his concern about threats that he supposedly received in an email. For the judges, this allegation was not enough since he is in one of the most secure prisons.
On this aspect, Romero said that the court considered that this argument was not valid and ordered the Prosecutor to investigate it. “Beyond that, he ordered that members of the Police protect and increase the protection in said center in order to avoid any mishap,” said Salcedo’s lawyer.

Weeks ago, a Court of Criminal Guarantees granted alternative measures (house arrest) to Daniel Salcedo, within the process for organized crime, but other investigations are being carried out against him that would prevent his release from the prison where he is located.
Judge Reinaldo Cevallos, who handled a case, said that Salcedo should remain in a prison for the validity of the sentence of thirteen years in prison, for the crime of embezzlement. (I)
