Defense of the prosecutor Juan Carlos I., investigated in the Naomi Arcentales case, will sue the State; model family will go to international organizations

Momentary arrest of a suspect in the death of Naomi Arcentales raised doubts both in part accuser and in part defender of the case

After the provisional arrest and subsequent release of Juan Carlos I., prosecutor of the El Carmen canton, raised last Tuesday night, the defense of the judicial official anticipates that he will ask international organizations for help to clarify this fact and that he will sue the State.

Juan Carlos I. was a partner of the model Naomi Arcentales, who was found dead weeks ago in an apartment in Manta.

On Tuesday night, the Police through their social networks confirmed the arrest of the prosecutor, but five hours later announced that the system that records the arrests against defendants was hacked. The Police indicated that an alleged alert issued by the Criminal Guarantee Court of the Provincial Court of Manabí was entered.

Julio César Cueva, defender of the Manabi prosecutor, pointed out that they were preparing lawsuits against the State and the Police for the arrest of his client, which he described as arbitrary. He also said that he will be reported for unauthorized access to the Police computer system.

He announced that he would make a request for precautionary measures before the Inter-American Court of Human Rights for violations of the rights of his client.

“The ballot was false, that someone accessed the system to enter false information, therefore, since this Wednesday I begin to work to sue the Police and sue the State, this cannot happen to a citizen without consequences … to sue the State to compensate Juan Carlos I., and above all to give guarantees of non-repetition, ”Cueva declared.

Who also announced a request for international help so that she can solve the death of Naomi Arcentales is the mother, Sara Sabando, who indicated that she feels ashamed and distressed by what she considers to be a lack of respect for the momentary capture and freedom of Juan Carlos I ., also claiming that these alleged hacking actions give an image of a country that is very backward.

“I try to trust the Ecuadorian justice, but look at everything that is happening, how am I going to trust myself, how, if they do not give me good results, if they themselves do not know what is happening with their system,” said Sabando.

Given this, Naomi’s mother pointed out that if Ecuador does not help her resolve the death of her daughter, which occurred on December 12, she will ask for support from international aid entities, although she did not specify what those organizations would be.

For Luigi García, defense attorney for the Arcentales-Sabando family, what was raised showed how fragile electronic access to the Police system is and that this would be a risk for the country.

The defender acknowledged that formally there is no request from the Prosecutor’s Office to a competent judge regarding the arrest warrant against the prosecutor Juan Carlos I., but that as a defense party he points out to the State Attorney General’s Office that at this time there are sufficient elements of conviction and the appearance for trial must be guaranteed with a precautionary measure.

At the moment, according to the defender, the accused party would have obstructed so that three witnesses of the day in which Naomi was found dead give their declarations.

García said that they will ask the FGE for these three witnesses, the counselor of the hotel where Naomi was found dead, the prosecutor’s brother and the best friend of the main suspect to render the version, but to appear with the public force.

He added that there are elements of conviction that appear in the prosecutor’s file, and that this would warrant that the Prosecutor’s Office ensure the appearance of the main suspect in the process, since it considers that now there is a risk that he will escape.

For his part, Cueva, defender of the prosecutor investigated for the death of Naomi, indicated that this Thursday from 10:00 at the Sheraton hotel in Guayaquil a press conference will be held, to give more details on irregularities in the case of the death of Arcentales, where the main suspect in that investigation, the prosecutor Juan Carlos I.

García also indicated that next Wednesday, January 5, from 3:00 p.m., a hearing to formulate charges will be held at the Manta Judicial House against two people in the trial for alleged sexual abuse against Naomi Arcentales, a fact raised on August 20. (I)
