Russian senators banned banks from writing off social benefits for debts

At today’s meeting, the Federation Council voted in favor of a law that fixes immunity from writing off by banks on account of a debt of social payments received by citizens by decision of the government or the president of the Russian Federation.

As emphasized in the Federation Council, “the law aimed at protecting citizens establishes a ban on writing off lump-sum social payments under executive documents, which are carried out within the framework of state support.”

At the same time, the debtor retains the right to send social benefits to pay off debts, subject to his voluntary consent to transfer or write off such funds.

At the same time, the law expands the list of types of income that cannot be levied in enforcement proceedings. These include payments made in accordance with the acts of the president and the government in order to provide social support measures to certain categories of citizens and families with children, social benefits for pregnant women, as well as cash payments made to low-income citizens as part of the provision of state social assistance, including on the basis of social contract.
