The main chief, who was dismissed, filed a protection action in the Provincial Court of Justice to be reinstated in office.

Mayor Pedro Palacios installed, on Tuesday, a first interim chief of the Cuenca Fire Department, after analyzing in the Law that the principal had finished his five-year term.
However, in response, the dismissed official filed a protection action in the Provincial Court of Justice on Wednesday to be reinstated in office.
The mayor’s decision to appoint Jorge Torres as head of the fire department was based on articles 55, 59 and 104 of the Organic Code of Territorial Organization, Autonomy and Decentralization (Cootad).

They specify that Firefighters are public entities governed by the Municipality, as well as in the thirteenth provision of the Organic Code of Citizen Security and Public Order Entities (Coescop), where it states: “In the event of the maximum vacancy The authority of conduction and command of the complementary security entity, will be substituted by the senior official for a period of no more than thirty days… ”.
The commission for Torres will be, as the law indicates, for a month, time in which the mayor will form a shortlist that designates a holder. According to Palacios, this decision is “respectful” of the law, that being “the only way to generate institutionalism.”
Torres is a firefighter with a 22-year career. He joined in 1995 as a private and in recent years he was in charge of the Prevention Department. In his first public statements, he said that his intention is to unite the institution and eliminate the classification between “hired firefighter and volunteer.”
But dissatisfied with this decision, the former first chief, Patricio Lucero, went to the Cuenca Judicial Complex on Thursday morning to file a protection action, “because many situations that have occurred are not in the norm.”

Meanwhile, his defense lawyer, Juan Francisco Delgado, explained that this was requested due to the violation of acquired rights (work and a decent life), even more so as a vulnerable person due to his hearing impairment.
“The claim is precisely to respect the colonel’s term of office that has not concluded in accordance with the norm and will have to return to office,” said the legal advisor. (I)
