The Prosecutor’s Office presented the appeal to the dismissal of Abdalá Bucaram and his son Jacobo because the elements of the accusation were not correctly assessed.
Partially accepted the appeal filed by the prosecutor Lidia Sarabia, within the criminal proceeding for the crime of organized crime, former President Abdalá Bucaram Ortiz and his son Jacobo Bucaram Pulley will be part of the list of five people who will face a trial hearing in this case. There is still no definite date for the diligence.
Last Wednesday night, a Court of the Provincial Court of Justice of Pichincha, made up of the judges Patricio Vaca, Miguel Narváez and Anacélida Burbano, after almost eight hours hearing, annulled the dismissal defined for the Bucaram, last October 4, by the criminal judge Geovanny Freire.
Prosecutor’s Office requested that Abdalá Bucaram, his son Jacobo and five other people prosecuted for organized crime be called to trial
The Court called the former president and his son to trial as perpetrators of an organized crime that would have been identified in the negotiation of rapid tests to diagnose COVID-19. They join those already called to trial by Freire: the Israeli Sheinman Oren, the agent of the Metropolitan Transit Agency (ATM) Leandro B. and Isabel P., who is currently a fugitive.
What the Provincial Court did not accept from the prosecutor Sarabia was the appeal to the ordered dismissal by Freire in favor of businessman Bryan Pérez and Verónica A. Both were confirmed their state of innocence.
Former President Abdalá Bucaram, who personally attended the proceedings at the Pichincha Court in Quito, wrote on his personal Twitter account: “The Judiciary orders the judges to revoke the dismissal and take Jacobito and me to trial. The prosecutor (Lidia) Sarabia full of hatred the jury got … they free the financier of the Israelites Bryan Pérez de Quito. They screw us at the coast ”.
Regarding the Bucaram, Freire said at the time in his resolution that they are private buyers of rapid tests for COVID-19, which were legally imported into the country. In addition, the judge explained that it had not been possible to establish the criminality on the storage of said evidence in relation to the ex-president, that Jacobo Bucaram acquired these tests without being delivered all of them and clarified that the evidence was not negotiated in public hospitals .
Regarding that reasoning, Sarabia assured the Court of Appeal that Judge Freire “He did not correctly assess” the more than 60 elements of conviction presented at the evaluation and preparatory hearing for the trial, held last September.
Jacobo Bucaram, after being expelled from Colombia, arrives in Quito shortly
EL UNIVERSO newspaper sought a statement from the former president’s defense, but so far it has not been possible to speak directly with one of his lawyers.
The Office of the Prosecutor maintained that the alleged irregularities committed by those called to trial for the crime of delinquency organized would have been configured between March and June 2020, but the activities carried out by the defendants to try to give legitimacy to their actions lasted until October of that same year.
According to the investigation by the Prosecutor’s Office, in this case a criminal structure was created that obtained economic benefits, even mobilizing goods and public servants of the AMT, whose agents allegedly in charge of providing security to foreigners Sheinman Oren and Shy Dahan, who was assassinated on August 8, 2020 in the Litoral Penitentiary, for the transfer of the COVID-19 diagnostic tests to Guayaquil.
In this case, the former agents of the AMT Cléver A. and Samuel S. were also prosecuted, but because they underwent an abbreviated procedure and accepted the facts with which they were related, on April 15 past Judge María Elena Lara, who was in charge of part of the process, He decided to accept this special procedure and sentenced each one to five years in prison.
The prosecutor Sarabia added that the investigated events occurred in the provinces of “Pichincha, Guayas, Santa Elena and Esmeraldas, places where this organized structure, conformed by public officials and private citizens, in a planned way, he directed the commission of illegal activities to commercialize tests to detect COVID-19 and medical supplies, without invoices and without paying taxes to the Ecuadorian State ”.
With the decision adopted by the judges Vaca, Narváez and Burbano, what corresponds is that the draw is carried out to find out which Pichincha criminal judges will be part of the Trial Court that in 2022 they will decide whether or not the five defendants are guilty of the crime of organized crime of which the Prosecutor’s Office accuses them.
