Actions and not just statements regarding one of the pillars of a democratic society such as the administration of justice. When it works independently, impartially, in a timely manner and in accordance with the legal system, without political-party interference, it creates trust and security.

The dilemma is justice or impunity. There are recent experiences in the region that reflect contrasts in the way justice works. The Peruvian case, with the acquittal of former president Alberto Fujimori, who was sentenced to 25 years for crimes against humanity, human rights violations. H H. and corruption, caused harsh criticism, even though he spent 16 years in prison.

However, despite all the mistakes, one must recognize the institutionality and functioning of the courts that put former presidents in prison, even though the first one has just been released.

Two other former presidents are still in prison. Pedro Castillo for attacking institutions and attempting a coup d’état. He is awaiting punishment. A third former president, Alejandro Toledo, was extradited from the United States accused of corruption, having received millions of dollars from the Odebrecht company.

The fourth former president, Ollanta Humala, was imprisoned for 9 months with his wife because Odebrecht financed his election campaign. The fifth former president, Allan García, committed suicide when he was about to be arrested for corruption due to the Odebrecht bribe. The sixth former president, Pedro Pablo Kuczynski, was prosecuted for money laundering and served 36 months of preventive detention under house arrest.

What a contrast in Ecuador: criminals convicted of corruption are called for political persecution. It is reflected in instability and legal uncertainty, whereby judges, by the way, not all, who act with impunity and against the law, are protected from the respective administrative and disciplinary body of the judiciary. They favor criminals and politicians convicted of corruption. They use tricks to delay court processes. What a contradiction when they promote a crude, dirty and vengeful campaign, without constitutional support, which wants to overthrow the state attorney in the Assembly, because she fights against organized crime, and they want to remove her in order to pave the way for impunity and sentence revision. They said they would not support the trial and do the opposite to make it sustainable, including the ruling bloc. Thus they dishonor their word.

Something unusual happens when the Judicial Council persists in the competition for the appointment of domestic judges, which everyone questioned, and which is full of irregularities, deficient, delegitimized and criticized even by the UN delegates. A council that illegally extends the mandates of judges to the extent that they took advantage of the dismissals and the declaration of nullity of corrupt actions.

Judges who must try members of the judiciary for influence peddling, obstruction of justice, judicial independence and money laundering, but who also delay their prosecution. The state cannot allow this process of further deterioration in the administration of justice to continue. (OR)
