According to our Constitution, the legislative function is performed by the National Assembly, which will consist of representatives elected for a period of four years. However, that deadline is shortened when the President of the Republic shortens his presidential mandate and the mandate of parliament members – by death on the cross – that is, when, in his opinion, the National Assembly has taken over tasks that do not fall under its jurisdiction. prior constitutionally positive opinion of the Constitutional Court; or if it repeatedly and unjustifiably obstructs the execution of the National Development Plan or due to a serious political crisis and internal unrest.

The State Electoral Council will hand over the credentials to the parliamentarians in another three months

Since the elections were held on August 20, it is assumed that at this moment in the month of September we should have defined 137 temporary representatives who will be there until 2025. However, as a result of a decision in my opinion outside the law, the National Electoral Council (CNE) decided to repeat the elections abroad for the members of the National Assembly (only in these constituencies) and for representatives (6) of Ecuadorian migrants, but in the second electoral round, so until the votes are counted and the challenge process is not completed, we will not have a properly formed National Assembly.

In the replacement of the next convocation of the National Assembly, there will be relatives of representatives who have already taken the mandates

And the absence of the National Assembly with all duly accredited members, until all appeals and demands that could possibly be presented are resolved, makes it difficult – at the very least – for them to meet, appoint their competent bodies and also appoint the next president and vice president of the Republic (take into account that the Constitution says that this can only happen on May 24 of the election year, which as we know will not be fulfilled in this transitional regime).

(…) I regret that in the near future I see a lack of minimum agreements in the… legislative function.

In view of the above, I regret to see a lack of minimum agreements within the legislative function in the near future.

First, it is not certain when the credentials will be handed over to the six representatives who will be elected abroad in this second round. Next, we must discuss the fate of the elected representative Patricia Carillo, who is apparently prevented from holding public office since he was removed from the position of Minister of the Interior in the cabinet of President Guillermo Lasso, and, finally, despite the fact that four benches have been defined (RC, Construye, PSC and ADN), so far no form of formal approach has been heard between the benches and other members of the assembly to choose their new authorities. Which does not mean, just in case, that there are no such negotiations.

The state requires and requires the new members of the assembly to agree on an agenda that contains basic agreements to fight against the scourge of crime, terror, poverty and hunger that accompany us every day. The country is experiencing a crucial moment. This is not the time for selfishness, compromises and disqualifications. The circumstances in which we are currently living should leave no room for personal or party plans, but for one single goal: saving Ecuador from the prostration in which it finds itself.

It’s up to you to start changing course. (OR)
