We wonder if we have reached the bottom or if we can sink even further. I believe the pit is very deep, as can be seen from the very unfortunate situation in Haiti.
The current Constitution created the rule of law and its authors say that it is the most guaranteed of all so far. It may be true, but this basic law is based on those who abuse the rule of law to obtain freedoms and privileges for people who are ultimately found guilty of various crimes. I will not write jeremiads about famous cases reported in the press. I will allow myself to insist on only two important issues: the lack of well-paid work and the crime that has almost suppressed the right of people to walk the streets, do business and live in peace.
Better institutionality
The public sector is hypertrophied. Excessive bureaucracy that we only notice through the news. It should be remembered that every official has a car and fuel paid for by the state, secretaries, offices and employees of the agency. It can be made bold because of the inevitable installation of sympathizers and friends of the winner of the next election. Bureaucracy takes a large part of the state budget.
realism and utopianism
The real engine of job creation is the private sector. The one who risks his capital and effort in order to earn more money with his creativity and ingenuity. Capitalism, with all its abuses and injustices, was and is the form of production that generated progress for most peoples. Socialisms failed and only spread poverty. Look at Venezuela, Cuba, Nicaragua, the former Soviet Union and its remnants. China has a sui generis economy as proclaimed by Deng Xiaoping, the true genius of modern China. A hybrid that accepts private capital, but keeps strategic industries for the state. There are many Chinese on the list of world billionaires.
We must encourage the creation of jobs through the necessary consensual reforms of the labor legislation. If young people find an honest and decent job, they can resist the offer of organized crime and their easy money.
limits of power
The reform of the current Constitution requires time, which the state does not have. Laws must be reformed in many respects, such as the type of privilege from the age of assassins. The killer kills knowingly, so we must know who they are and not hide their names. Changes are the task of honest and wise legislators. It’s difficult, not impossible. Perhaps the Constitutional Court could launch creative initiatives to dismantle the system of multi-jurisdictional judges and their national jurisdiction, because they abuse their powers. The adjective itself is an aberration. No one can know everything, it is a physical impossibility. But they can be honored for making good use of their legal skills and their intimate convictions when appreciating evidence of crimes.
The insecurity we suffer has two solutions: the work and honesty of the judges. Public forces and the prosecutor’s office and the police are factors of security and peace. We have to support them. (OR)
