“Moreover, if the driver commits two or more offenses, they will be punished for each of them,” he said.
According to the lawyer, on the same day they can impose punishment for similar violations, for example, for speeding in different areas. At the same time, a person cannot be fined for the same violation several times on the same day if it cannot be eliminated on the spot: for example, for driving without an OSAGO policy.
“If, during the initial preparation of the protocol, the fact of a violation was established, a fine was imposed, and a deadline was presented for eliminating the violation, then when re-compiling the protocol, you should present the first protocol and resolution to the official, indicating that you are going to the place of elimination of the violation,” the lawyer said.
The expert added that this should also be reflected in the new protocol, in the column “explanations and comments on the content of the protocol”, which will be needed to appeal the subsequent decision.
“If the decision was made by the traffic police inspector, a complaint against the decision can be filed with a higher official – the head of the traffic police department, whose employee issued the decision, to a higher authority or to the district court at the place of the case,” the lawyer concluded.
