Avanza País seeks to repeal the rule that obliges online businesses to place their RUC in advertising

Congresswoman Adriana Tudela, from the Avanza País bench, proposes to repeal the measure that requires all businesses, from Saturday, July 1, to place the RUC number and company name in advertising carried out on digital platforms, which includes social networks such as Facebook, Instagram and TikTok.

Bill 5434 states that it has the objective of restoring “the proper functioning of digital advertising.” In this way, the aim is to modify article 3 of Legislative Decree 943 so that it remains as it was before Legislative Decree 1524, which was published in February of this year.

“By modifying article 3 of Legislative Decree 943, through Legislative Decree 1524, new mandatory applications are established for the RUC, whose purpose is not to carry out acts or procedures before the Sunat, distorting its purpose”is stated in the document.

It is specified that placing this information, which is mostly unrelated to the brand, violates the main objective of advertising the main characteristics of the company, which would affect its reputation, one of the most important assets. Besides, their freedom of enterprise would be violated.

According to Sunat, this provision grants benefits to users, for example, the client will be able to identify who he is buying from, while sellers will be able to make their brand better known and therefore have more sales. “If, for example, you are going to make a purchase online, you will see on the networks that there is a publication with RUC and company name and you will see another publication where there is no such information. Which one are you going to buy? Obviously the one that does have it because it gives you security since it is a formal business”said Oscar Osorio, specialist of the Sunat to The Republic.

The legislative initiative was presented on Wednesday June 21 and is already in the Economy Commission for analysis before going to plenary for debate and voting.
