When the Constitutional Court gave way to the political persecution of the President of the Republic, Guillermo Lasso, the parliamentarians became judges and the question arises whether it will really be a trial which, according to the first meaning, the dictionary of the Royal Spanish Academy (RAE) is “the faculty of the soul by which a person can distinguish good from evil and truth from lies”.

Judges must be persons characterized by honesty, impartiality and knowledge.

Honesty enables them to act with good judgment and fairness, impartiality forces them not to favor one over the other, and knowledge will force them to investigate the truth of the acts they judge so as not to commit errors or injustice. It is difficult to be a judge, and even more difficult to be a good judge when the one who judges at one level causes the state. There is no one to complain about the sentence of the supreme judge. In this case it is the National Assembly.

Regarding the quality of legislators, Rousseau said that legislators should have “a supreme intelligence that sees all human passions and has none of them (…) in short, that, carving a distant glory in the progress of time, they could work in a century and enjoy in the second. To give men laws, one would need gods. Some sympathetic readers will wonder if this columnist is crazy for copying the words of a 17th century man and wasting his time. I can answer by remembering that the Genevan is one of the most important philosophers of the Enlightenment, whose ideas created the foundation of today’s democracies. If they are heavily criticized these days, it is not because the basic ideas are wrong, but because we do not practice the virtues that it requires.

And I am writing these ideas with a glimmer of hope, considering that in the current convocation of the Parliament, there are legislators who can reconsider their ideas and take those previously written as a basis on which to base their decisions. It is good to remember concepts that were learned growing up or that were not known due to mediocre teaching.

Judges must be persons characterized by honesty, impartiality and knowledge.

I may be mistaken, but this article will be published on Good Friday, which contains the hope that there will be a resurrection and that the truth, whatever it may be, will inspire the decisions of the judges.

The alternative is to take the position of the executioner, the one who executes the punishments dictated by others. The executioner does not decide, he only executes. His sad and cruel role is to place safety on the convict’s neck. The executioner does not investigate. Others decide for him. Today’s killers are motorcycle executioners. Someone pays them to kill.

Legislators are judges who must choose. The criminal judge decides according to his intimate conviction. He discerns, analyzes the evidence, learns what he does not know, as well as the orders he has received and compares them with his personal beliefs and justice.

Finally, judges, who are also politicians, must take care of what is best for the state. We are threatened by criminal mafias that can buy everything and the anarchy inherent in the troubled times in which we had to live. The Risen One has already said: the truth will set us free. (OR)
