Assembly members believe that the prison crisis is not solved with the approval of new laws

The Government is preparing a reform project to the COIP that would grant authority to gang leaders in the face of events inside prisons.

In the National Assembly, not all legislators are convinced that a new law will solve the country’s prison crisis, but rather demand concrete actions to combat insecurity in Ecuadorian prisons.

So far this year there has been a series of riots and murders inside the Litoral Penitentiary; the last one appeared at the weekend: there were more than 60 deaths.

For the coordinator of Pachakutik, Rafael Lucero, the only culprit of the 320 deaths in prisons in 2021 is the State, because it does not provide the necessary guarantees for good living. That it is not possible for the three security rings that exist in the prisons to be circumvented and continue to enter weapons; all it reveals is that criminal gangs are in control in Ecuador.

That Pachakutik will provide the entire legislative mechanism so that the president and all control bodies have the necessary tools to enforce the law in the country. That if the Executive sends a project to face the prison issue, the respective procedure will be given, if that is what the people need.

The national coordinator of that political group, Marlon Santi, asked the Government to grant pardon to hundreds of people who are in jail for being social fighters.

That the Prosecutor’s Office and the National Court of Justice have to watch over the rights of Ecuadorians. And he called on the Constitutional Court for not allowing the intervention of the public force in prisons during this crisis.

From the correísmo, the legislator Pabel Muñoz (UNES) questioned that the Government considers that a law will eliminate the prison crisis. What the regime lacks is forcefulness in what should be done in the crisis; must show decisiveness and operational capacity, he noted.

Muñoz said that the prison crisis is not a lack of regulations, because Ecuador has a large number of laws and little operation of them. The central problem is one of institutionality, since before there was a separate ministry: the management of the security management policy.

“A person cannot be coordinating the dialogue in the Assembly, the dialogue with the other functions of the State, the dialogue with the decentralized autonomous governments, the appointment of governorships and also take charge of the country’s security,” said Pabel Muñoz, referring to to the Minister of Government, Alexandra Vela, after insisting that the problem is not one of laws, but of not having competent people and having an institutional problem.

The coordinator of the Democratic Left, Alejandro Jaramillo, recalled that there are already in the COIP all the crimes that are intended to be classified as a result of the prison crisis, such as indirect responsibility, illicit association and organized crime. That at this time what is needed is for justice operators to properly apply the norms, and for the National Assembly to carry out political control so that there are no acts of corruption in the justice system.

From the ruling party, legislator Ana Belén Cordero said that the president hopes to send a bill to expand the criminal offense to hold the heads of organizations that operate inside prisons responsible for what happens in them.

To what extent the heads of criminal organizations that operate in prisons are responsible for the events that occur, such as blowing up a wall, murdering a person deprived of liberty or violating their dignity, is what the new reform seeks to determine, Lamb scored. The expansion of this authorship in terms of the degree of participation in a criminal offense is what the project prepared by the Executive will contain, he explained.

The project announced by the Executive will have three axes: the first, to classify those who belong to the mafias and who from outside intend to run the prisons; the intention is for this sector to face justice.

Another issue is the guarantee of the progressive use of force so that the joint action of the Police and the Armed Forces makes it possible to contain any event that occurs in prisons and thus avoid what happened in the Penitentiary.

The Social Christian Henry Kronfle stressed that the first president has brought together all the authorities and achieved coordination on the crisis in the prisons, but that they will wait for him to submit the project and then analyze it before taking a position. (I)
