The Judicial Unit for Family, Women, Children and Adolescents of the canton of Santa Rosa, province of El Oro, granted precautionary measures to the counselor of the Council for Citizen Participation and Social Control (CPCCS), Gina Aguilar Ochoa, and ordered the National Assembly to within 72 hours possesses the principal and substitute members of the CPCCS.
In addition, it provides that the National Assembly refrain from carrying out any act tending to delay the execution of this resolution under warning of the sanctions established in article 22 numeral 4 of the Law of Jurisdictional Guarantees and Constitutional Control. That is, initiate the procedure for his eventual dismissal.
The struggle for political powers devastates the institutional framework and maintains eight organizations without holders or extended
Aguilar Ochoa, was sworn in as alternate director on December 5, 2022; Then, on January 23, the Constitutional Court dismissed the seven CPCCS counselors: Hernán Ulloa Ordóñez, María Fernanda Rivadeneira, Sofía Almeida Fuentes, Francisco Bravo Macías, Juan Javier Dávalos, Ibeth Estupiñán Gómez and David Rosero Minda.
When raising the constitutional action, Gina Aguilar, explained that currently there are only two appointed directors who are in office as principals; consequently, the plenary of the CPCCS cannot function, that is, it is not possible for it to meet to make decisions.
According to the counselor, this responds to the “deliberate and irresponsible breach of functions by the plenary session and the Presidency of the National Assembly”, which have even canceled inauguration sessions, despite the fact that they have the certification of the National Electoral Council with the list of people to whom it corresponds to lead.
If the National Assembly does not immediately take office of the councilors, it will not be able to meet in order to comply with Ruling No. 1219-22-EP/22 of the Constitutional Court; therefore, he warns “I am facing the obvious risk that the Constitutional Court dismisses me as a counselor; which would affect my rights to political participation for two years, in addition to my current right to work and the exercise of my rights to participate as a constitutionally and democratically elected counselor”.
In the brief presented to the Judicial Unit, Aguilar warns that they cannot make decisions on the appointment of one of the candidates from the fourth shortlist of the National Court of Justice to preside over the Council of the Judiciary; being that as of this date only the director Olindo Nastacuaz Pascal and the undersigned Gina Aguilar Ochoa are in office.
On the list to take office are: Carlos Figueroa; Aland Molestina Malta; Marlene Montesinos; Catalina Perez Avila; Mauricio Gallardo Guillen; Bernardo Canizares; Carlos Mosquera.
Meanwhile, Teddy Tama Aguirre, Mariuxi Moreira Román and Graciela Viviana Mora Ramírez, cannot hold office until after the elections, that is, February 6, because the three are candidates for the position of councilors of the CPCCS. (YO)
