ECHR allowed Ukraine and the Netherlands to sue Russia in the Malaysian Boeing case

The European Court of Human Rights ruled that complaints related to the case of the crash of the Malaysian Boeing 777 (flight MH17) fall under the spatial jurisdiction of Russia, RBC reports.

The ECHR justified this decision by the “decisive level” of Russia’s influence in the LPR and DPR and the “active presence in the Donbass” of the Russian military (Moscow has repeatedly denied accusations of sending military personnel to this territory). The ECtHR said in a statement that Moscow “supplied weapons and other military equipment to the DPR and LPR, had a significant impact on their military strategy.”

“Evidence was also provided of political support for the “DPR” and “LPR” and the active role of the Russian Federation in their financing. Complaints by the government of Ukraine regarding the events that took place entirely in the territory held by the separatists since May 11, 2014, thus fall under the jurisdiction of the Russian Federation,” the ECtHR decision states.

Recall that in March 2022, Russia announced its withdrawal from the Council of Europe. In September, the country finally withdrew from the jurisdiction of the ECtHR. In the summer, Russian President Vladimir Putin signed a law allowing not to execute decisions of the ECtHR, adopted after March 15.
