Men who incinerated a kiosk in Centennial Park will serve preventive detention in the Penitentiary

In a real contest of infractions, two people accused of setting fire to a kiosk located in Centenario Park, downtown Guayaquil, are prosecuted.

The Prosecutor’s Office indicated this Thursday the 19th that Marcos R. and Nayib L. will serve preventive detention in the Litoral Penitentiary.

The two individuals are prosecuted for the crimes of damage to the property of others and drug trafficking.

At 04:15 on Wednesday the 18th, police personnel on duty, alerted by the ECU 911 Security System and assisted by the videos from the surveillance cameras of the Corporation for Citizen Security of Guayaquil, identified two people inside the a building located on José de Antepara and Hurtado streets.

They would have entered the building after setting fire to a food kiosk located on one of the sidewalks of Centennial Park.

Through the surveillance cameras, the corresponding follow-up was achieved from the moment of the incident until they entered the condominium.

Police personnel, once the location of the alleged perpetrators of the act was confirmed, and continuing at the determined time as flagrante, entered the building and found them in a room, where they were detained.

In his possession were found four cell phones and several grams of cocaine and marijuana (cigarette-type cylindrical wrappers), presumably for micro-trafficking.

Both were transferred to the Flagrancy Unit in the Model Barracks and placed under the orders of the judicial authorities.

The Prosecutor’s Office indicated that in the flagrante delicto hearing, held in the Cuartel Modelo Judicial Unit, prosecutor Leonelo Pérez Ortega presented as elements of conviction the informative and apprehension report and other evidence that they were entered into the chain of custody of the Anti-Narcotics Police.

Flagrante delicto judge Marcos Guerra accepted the request of the Prosecutor’s Office and ordered preventive detention for the two subjects. The respective incarceration tickets were issued for later transfer to the Litoral Penitentiary. The tax instruction is scheduled to last thirty days.

As indicated by the Prosecutor’s Office, this case is processed based on articles 204, second paragraph, and 220, numeral 1 literal b, of the Comprehensive Organic Criminal Code (COIP) -in a real contest of infractions-, which are sanctioned with a custodial sentence freedom from one to three years.
