These are the offenses in which points are not reduced from the driver’s license

The reduction of points to the driver’s license is one of the common consequences of transit infractions serious. However, not all the offenses committed on the road reduce points to the license.

From reform to Traffic Law, in August 2021, all violations ranging from third to seventh class will not reduce points on the driver’s license. According to the Comprehensive Organic Criminal Code (COIP) there are 79 causes to which the sanction does not apply in Ecuador.

How to drive if you have an expired license

These are some of the most frequent infractions that do not warrant a reduction of points to the driver’s license, but do have a monetary penalty according to the Unified Basic Salary, which in 2023 was set at $450.

Art.388. Third class: 40% of the Unified Basic Salary ($180) (numeral 1 to 9)

  • Anyone who stops or parks vehicles in security zones, curves, bridges, entrances and exits, tunnels, without taking security measures.
  • The driver of public or commercial transport who refuses to provide the service.

Art.389.- Fourth class: 30% of the Unified Basic Salary ($135) (numeral 1 to 12)

  • The or the driver who does not obey the manual signals and the orders of the traffic agents and other signs placed on the public highway.
  • Vehicles without identification plates.

Art.390.- Fifth class: 15% of the Unified Basic Salary ($67.50) (numeral 1 to 22)

  • Turn off the engine on a slope.
  • Drop off or pick up passengers at prohibited sites.

Art.391.- Sixth class: 10% of the Unified Basic Salary ($45) (numeral 1 to 21)

  • Contravene the regulations established in relation to the emanation of gases.
  • Do carry a first aid kit and a fire extinguisher.

Art.392.- Seventh class: 5% of the Unified Basic Salary ($22.50) (numeral 1 to 15)

  • Using the horn inappropriately and repeatedly.
  • The driver who does not wear a seat belt.

How to check the fines on the license

Through the website of the National Traffic Agency www.ant.gob.ec, Ecuadorian drivers can check the offenses they have committed and the value of the fine to pay. By entering their identification number, they will have access to the information, in addition to the number of points they have on their license.

Although the ANT is the entity in charge of transit in the country, there are municipalities that have jurisdiction over transit in their localities. In Guayaquil, the entity in charge is the ATM. In Samborondón it is the ATV.

Not carrying the license when driving is also a violation, which is punishable by a fine of 10% of a Unified Basic Salary ($45). Driving without having obtained a license implies three days of imprisonment, a fine of one SBU ($450) and a reduction of 10 points to the license. (YO)
