How to know if I have a coercive judgment in Ecuador

A coercive trial is a short-term process that allows debt collection, mainly from overdue portfolios of banks, in a period of less than one month and no more than three months. This process is applied when a person or entity has not canceled a debt within the established term.

This procedure is based on the norms contemplated in the Civil and Civil Procedure Codes. When all instances are exhausted, a coercive trial is initiated for the debtor to pay or resign assets, when the coercive is put in, assets or money in bank accounts can be lost since these can be frozen. The Property Registrar is notified to order the seizure of the assets, according to the amount of the debt.

How do I know if I have a coercive trial?

  • Enter the website: https://www.funcionjudicial.gob.ec/
  • Consult for the number of the judicial process
  • Ask for the identification number or names / surname of the plaintiff
  • Consult the ID or names / surname of the defendant or defendant
  • Fill in the required fields. Do not forget that one of the data is enough for the system to give you results.
  • Click on ‘Search’.

If the person has a lawsuit, the reason for which it was prosecuted will appear, the number of the process, the date of admission and the details of the same can be seen by clicking on the folder icon. If the person has no cause against you, the message will appear: “No results found.” (YO)
