Hours after the release of Daniel Salcedo Bonilla, the State Prosecutor’s Office has made public its rejection of the decision of a judge from Paján, in Manabí.
The entity rejected the judge’s decision, arguing that it translates into “a misinterpretation of the current legal regulations”, due to the fact that having issued a sentence in the first instance, the preventive detention times no longer apply.
Judge Simón García Tello, of the Multi-competent Judicial Unit in Non-Criminal Matters and Adolescents based in the Paján canton, Manabí province, ordered the release of Daniel Salcedo Bonilla considering that in five criminal proceedings against him there has already been an expiration of preventive detention.

The Prosecutor’s Office recalled that three sentences for different crimes weigh on Salcedo. One of them is for embezzlement, in the case of acquisition of body covers, in which he received a 13-year sentence. He has another four years for fraud procedural.
In addition, he has another three-year sentence for bringing prohibited items into jail.
The Prosecutor’s Office indicated that other investigations for irregularities in purchases in other health centers remain open, which was discovered in a pandemic.
Salcedo was captured when he tried to leave the country in a small plane and had an accident in Peruvian territory.

The Prosecutor’s Office indicated that this use of allegations to recover freedom has been repeated on other occasions and after appeals the decision has been reversed.
The body has called on justice administrators so that, in respect of the rights of victims, it is applied objectively with the law. (YO)
