A survivor’s pension is a benefit that is payable in the event of the death of a relative. Due to the fact that most widows decide to apply – the benefit gained the colloquial name, i.e. retirement from the husband. It can be obtained not only, and in addition to the application, it is necessary to meet the conditions.

Retirement from a husband not only for a widow. Who can apply for the benefit?

The survivor’s pension is available to family members of a person who, at the time of death:

  • had an established right to an old-age pension or met the conditions for obtaining it,
  • had an established right to a bridging pension;
  • had an established entitlement to a disability pension or met the conditions for obtaining it;
  • she was receiving pre-retirement allowance;
  • she was receiving a pre-retirement benefit;
  • she was in receipt of a teacher’s compensation allowance.

Potentials include: spouse / spouse, own children, children of the other spouse and adopted children, grandchildren and siblings, parents.

Many people choose not to apply once they have read the terms and conditions. The claimant must waive his own benefit in order to receive the survivor’s pension. The retirement pension from a husband is not 100 percent, but only 85 percent for one applicant. More people can apply and then it amounts to:

  • when two people are entitled to the pension – 90 percent of the benefit,
  • when the pension is due to three or more persons – 95 percent of the benefit.

You can apply in person at the ZUS office as well as electronically. The template of the form is available. It is also worth attaching documents:

  • a document confirming the applicant’s date of birth
  • a document stating the date of birth and date of the person after whom the pension is to be granted
  • a document confirming the degree of kinship (affinity) with the deceased person
  • an abridged copy of the marriage certificate, if a widow or widower is applying for the pension, or a spouse – a separated or divorced spouse
  • a certificate of the health condition of the child, widow or widower, issued by the attending physician, if the granting of the pension depends on the determination of incapacity for work
  • school attendance certificate if the child is over 16 years of age
  • a document confirming the right on the day of death of the deceased person to maintenance on his part, established by a judgment or a court settlement,
  • a document confirming the existence of a maintenance obligation by operation of law, if the divorced or separated spouse has not had maintenance established by a judgment or court settlement.
