A judge from Barcelona has rapper Morad acquitted and another man of the crimes of attempted robbery in an inhabited house and threats that were imputed to them, as their participation in the events was not proven.
According to the ruling, to which laSexta has had access, “not sufficiently accredited” that both defendants tried to access a Barcelona estate to commit a robbery and it has not been sufficiently proven that they threatened a neighbor of said estate.
Both defendants had denied their participation in the alleged robbery attempt, which would have occurred in april 2018 in Barcelona, when a neighbor surprised two people supposedly trying to force the portal with a screwdriver and that they would have threatened him with death when they realized that he had photographed them.
Sentence
However, the judgment states that, despite the fact that the witness stated that he seemed to see how a person was trying to manipulate the lock with a screwdriver while another was looking at the street, this did not present “any type of damage”so “it is not accredited with the rigor and certainty that criminal law requires that the accused tried to force the lock.”
“There is not enough proof of chargebecause not even the eyewitness is sure that the defendants carried out such an action”, the sentence affects, which concludes that “the objective type of the crime of robbery is not proven”.
As for the threatsAccording to the witness’s statement, those two individuals told him “son of a bitch, we are going to kill you”, a fact that, the magistrate concludes, would constitute a minor crime of threats. In addition, the judge considers that there is “reasonable doubt” about authorship of the facts. The poor quality of the photographs provided stands out in the sentence, in which “it is difficult to recognize the people who appear in them”.
Thus, the judge issues a acquittal and acquitted of both crimes imputed by the Prosecutor’s Office to the two defendants and for which it requested two and a half years in prison for them.
