TVP will get up to 400,000 PLN penalty? That’s why the KRRIT initiated the proceedings

According to the “must Carry, Must Offfer” principle in Poland, the operators of paid television and streaming services are required to provide their subscribers with access to specific stations. In turn, broadcasters must offer these channels free of charge. Is also subject to it, but The liquidator of the company Daniel Gorgosz did not agree to distribute the signal as part of the Pilot WP service. Therefore, headed by Maciej Świrski, decided to initiate proceedings aimed at sending the liquidator responsible.

During a press conference, he revealed that Gorgosz was called to provide explanations in this matter at the beginning of July 2024. So far, however, KRRiT has not received any response from the TVP liquidator. – The call was sent on the basis of Article 10 of the Broadcasting Act – he said. – We have not received any information from Mr. Gorgosz since July 2024, which is why I initiated the proceedings for punishment responsible for providing this information – he announced.

It didn’t end there. Świrski emphasized that if he did not comply with the applicable law, i.e. he will not provide TVP1, TVP2 and regional TVP3 programs, then another proceeding will start. However, its consequence will be a financial penalty. – According to Article 53, a penalty will be imposed, which is 50 percent. Frequency use fees. In total, it will be around 400,000 PLN – explained the head of the National Broadcasting Council.

According to virtual media, others also have reasons for concern. During the conference, Świrski announced that he was going to take a closer look at this matter. If he determines that TVP does not provide channels with other websites on the principle of “Must Carry, Must Offfer”, it will also “react”. At the same time, he admitted that this is not the only station that evades the application of this law. However, he did not want to reveal “who else he has in the crosshairs”. “I will organize this problem,” he assured. Finally, he declared that similar sanctions would also be applied to other broadcasters, as long as there were adequate premises.
