The bailiff is a public official, which means that he has the right to take a bank account and collect a certain amount from it from remuneration for debts and other obligations. It is worth remembering, however, that as the minimum salary increases, a sum free from the so -called bailiff classes. How much is now and why are the voices that the law must be changed?
How much does the bailiff have to leave on the account from January 2025? A higher amount is more problems
From January 1, the minimum wage increased to PLN 4,666 gross (it was 4242 zlotys early), which means that the amount free of execution also increased. According to the law, we are talking about a minimum wage reduced only by social security and PPK contributions and income tax advances, i.e. about PLN 3,510 gross (exception is the execution of maintenance). In short: the bailiff cannot deduct in people earning a minimum, and in those with a higher salary, only from a surplus over PLN 3,510.
Although in theory the law regarding bailiff’s occupation does not change, the number of people who do not have to be afraid of it is constantly growing. According to Rzeczpospolita.pl, in 2021 it was 1.6 million people, and Now every fifth Pole receives minimal wage. In total, the problem concerns 3.5 million compatriots, with no debt enforcement. For this reason, voices are increasingly appearing regarding the change of regulations so that you can also receive a minimum amount.
Local governments also have a problem. “They have absolute awareness”
It turns out that people receiving the minimum wage know perfectly well what situation they found, so that not the bills for the phone, or even for parking and related penalties. – Most debtors are absolutely aware that the lowest domestic is inviolable – Rafał Kucharczyk, vice -chairman of the City Council in Toszek and a court bailiff admitted in an interview with law.pl. – So they park where they want, because they know that since they are officially employed, for example, part -time, for the lowest national, they can not be done much – he added.

The Ministry of Justice sees the problem. Will there be a solution?
At the moment, it is not known whether the changes regarding bailiff classes are being prepared. Nevertheless, the Ministry of Justice pointed out the problem last year. Deputy Minister Zuzanna Rudzińska-Bluszcz admitted that allowing the possibility of enforcement from the minimum remuneration for work will make debtors to be able to pay off their obligations fasterthanks to which they will avoid entering the debt loop. In addition, this solution should positively translate into the system itself. “It will no longer make sense to hide the real amount of the salary obtained,” she said.
