The court has resolved the dispute between TVN and the National Broadcasting Council. The station’s complaint has been dismissed

After a several-month battle between the National Broadcasting Council and TVN, the Provincial Administrative Court in Warsaw ruled on the complaint filed by the station. The regulator withheld the extension of the license for TVN Style for several months, arguing that it had not fulfilled the conditions of its previous license.

On July 11, the Provincial Administrative Court in Warsaw issued a ruling in a dispute that has been ongoing for several months between the National Broadcasting Council and TVN Style. The regulator withheld the extension of the station’s license for 11 months after an audit. It showed that the shares of documentaries and current affairs programs were 3.7 and 4.7 percent lower than those previously declared by TVN Style.

After the inspection, the Chairman of the National Broadcasting Council called on the station to meet the programming conditions that are part of the license. “In accordance with art. 10 sec. 3 of the Act, the Chairman of the National Broadcasting Council may call on the broadcaster to cease activities in the scope of providing media services if they violate the provisions of the Act, resolutions of the National Broadcasting Council or the terms of the license. In connection with the above, I call on the Broadcaster, on the basis of the aforementioned art. 10 sec. 3 of the Act, to immediately cease activities consisting in violating point I sub-item a) of license 236/K/2013-T and to adjust the program ‘TVN Style’ to the programming conditions specified in the license,” wrote Maciej Świrski in the application.

The station filed a complaint against the motion of the KRRiT chairman in court. However, the body shared the Council’s position. “The court shared the position of the KRRiT Chairman, stating that the content of the program declarations is clear, and as part of the concession, these declarations are binding on the company, which cannot withdraw its own declarations. Therefore, TVN SA’s complaint is unfounded and should be dismissed,” the KRRiT reported on Friday.
