A few days ago, Prof. Tadeusz Kowalski was a guest on Radio Trójka, where he spoke about, among other things, the payment of funds from RTV subscription fees to public media and decisions made by Maciej Świrski. Asked whether the chairman is acting in accordance with the law, he stated: “In my opinion, he is acting illegally, but he is not the only one. He can say that he is implementing the resolution of the Council, i.e. the four people who decided so by adopting two resolutions at the beginning of the year. I believe that these resolutions are invalid by operation of law.”

Then, Prof. Tadeusz Kowalski stated: “This action is persistent. It is similar to the situation of a student or a naughty child who says that he will freeze his ears to spite his mother. It is very often the case that courts refuse to establish a deposit. Then a complaint is filed against the registrar’s decision. In some cases, this complaint has been dismissed. Then an appeal is filed, which goes to the district court. There may be 70 thousand cases to be considered in the district court and this case is one in the queue, waiting to be considered.”
After Tadeusz Kowalski’s visit to Radio Trójka, the National Broadcasting Council issued a statement in which we read, among other things, about the “false and defamatory” words of a council member and that transferring subscription funds to court deposits is legally permitted. “By filing for the rejection or dismissal of applications for consent to deposit money, the liquidators themselves blocked the possibility of releasing them, because some courts decided to dismiss or reject these applications on this basis. In contrast, other courts accepted the funds for deposit and have already transferred them to authorized persons. This discrepancy in the case law of the courts in Poland is incomprehensible. Therefore, subscription funds are not “frozen” and unavailable to companies that receive financial support from the state budget regardless of the subscription fee,” reads the position of the National Broadcasting Council.
