Nevertheless, everything indicates that if they do not pay the legalization fee, they will be forced to demolish it.

In 2023, the District Construction Supervision Inspector in Ełk sued a couple who built a tin roof on the plot without obtaining the appropriate permit. According to the website praw.pl, the couple did not agree with the allegations and submitted a decision on development conditions based on the garage from 2008. In addition, they pointed out that the structure they built had no access road and was only used to store gardening equipment and bicycles. However, it turned out that in all this the couple forgot to pay the legalization fee, which amounts to PLN 5,000. zloty.

Because the couple did not agree to the fee, the case was sent to the Warmia-Masuria Province Construction Supervision Inspector, who upheld the earlier decision, and then to the Provincial Administrative Court in Olsztyn. The couple argued that they had been misled, hence the lack of payment, and that they had obtained the consent of both the housing community and the conservator of monuments. However, the court upheld the decision to pay the fee. If the couple does not do this, the glove box will need to be dismantled. – In this situation, the Inspector’s imprecise description of the facility as a “garage”, while the complainants do not use the building for such a purpose but to store gardening equipment, is irrelevant to the case – it was stated. According to the verdict, the defendants were informed about the fee.

As we can read in art. 29 of the Construction Law, you do not need consent to start work and construct a detached single-story farm building or garage (including a tin shed), as long as its area does not exceed 35 square meters. In addition, it is worth remembering that there can be a maximum of 2 such buildings for every 500 square meters. If the construction falls within the above-mentioned framework, it is sufficient to report it to the appropriate authority 30 days before the start of work. In the case of larger metal sheets, it is necessary to obtain the appropriate permit, without which you should not even start work. This issue is regulated by Art. 28 section 1 of the Construction Law. The application should be sent to the commune office, where a garage plan must be submitted along with the application.
