On Friday, May 17, Tomasz Sakiewicz, Michał Rachoń (program director) and Jarosław Olechowski (head of publishers) officially submitted a license application to the headquarters of the National Broadcasting Council. – We are building the largest news television in Poland, one of the best in Europe. We want to reach every Pole’s home and this concession will make it much easier, said Olechowski. TV Republika also encouraged its viewers to support this candidacy and send messages to the National Broadcasting Council.
As it turns out, obtaining a license for television will not be that easy, and it is not necessarily its fault. Maciej Świrski appeared on Telewizja Republika and outlined the situation. When asked about the end date of the competition, he was unable to provide specific information. – It depends on how many applications there are and how complex these applications are in terms of formal and substantive aspects. First, all requirements related to such an application are checked. A matter of formalities, whether all signatures are present, certificates and substantive considerations. To put it colloquially, whether all tables are filled in properly. Then there is an analysis of the financing of a given program – said Świrski.
– The data is presented by the Department of National Regulation to the Council at its meeting. The National Broadcasting Council decides by vote who to grant a license. This is yet to come. At the moment, the analysis is not substantive, but formal. The content analysis will begin soon. This will be considered by the National Council at one of its meetings. Probably in the near future. There’s no need to rush too much. We know that there are some formal deficiencies in one of the candidates. There must be a request to fill in the gaps. Therefore, this procedure takes longer. We’ll see how long it will take, he noted.

However, this is not the end of the problems. The granting of licenses may be suspended when an application regarding the head of the National Broadcasting Council is submitted to the State Tribunal. – The problem is that, according to the applicable regulations, a person brought before the State Tribunal is suspended from his/her duties. If I was brought before the State Tribunal and the concession had not yet been signed, then the concession would not be signed. The whole process stops. Moreover, all administrative processes of the National Broadcasting Council are stopped, Świrski points out.
– It is the chairman who, on the order of the National Broadcasting Council, signs all concession documents and so on. If someone came up with the idea of suspending the issue of concessions for the Republic by suspending the chairman of the National Council, as Sienkiewicz mentioned recently, we will see. I am of the opinion that Article 128, paragraph 3 of the Penal Code is binding. All those who signed this motion in the Sejm should remember that whoever forces an action specified on a constitutional body by means of an unpunished threat will be subject to a penalty of up to 10 years, he added.
