The case between Kaja Godek and Bart Staszewski began in 2021 during the Equality March in Lublin. Godek, famous for her homophobic statements, clashed with LGBT+ activist Bart Staszewski, telling him: “I disgust you, you are disgusting”. Godek claimed that Staszewski committed pedophilic acts by sending photos, which caused huge controversy.
Recording evidence
In response to the accusations, Bart Staszewski posted a video on the Internet in which Godek’s statements can be heard. Despite the evidence, the court found that the case had little social significance and discontinued the proceedings. Staszewski demanded an apology and a payment of PLN 10,000. PLN for LGBT+ organizations.
Court decision

Kaja Godek on social media convinces her that she is the victim of the whole situation. “Today, the District Court for Warsaw Wola discontinued Bart Staszewski’s case against me and my case against Bart. We will know the justification in 7 days.” She also described how Staszewski used the trial time when she was unavailable: “2 years ago, Bart used the time of the trial and the fact that I was in the last weeks of pregnancy with my fourth child to hate me. It was shocking to me that he could behave like that. He submitted a video to the trial in which he himself behaved in a way that could exhaust the paragraphs, so there was a mutual indictment”

Bart Staszewski is an LGBT activist, director and film producer. He is the co-founder of the Equality March in Lublin and Miłość Nie Wyleża associations. His film “Article Eighteen” shows the situation of LGBT+ people in Poland. Staszewski was included in the Time 100 Next 2021 list, which includes the most influential people of the future.

Bart Staszewski talked about his experiences in a conversation with Dawid Dudka in Onet. He described how police raided his family home on Easter and his photo appeared in church in a negative context. “I have one question for the stars of PiS’s TVP, who insist that they stay away from politics: where were you when bags of urine were thrown at me in the street?” – added Staszewski.
The future of the case
Bart Staszewski announced that he would appeal against the court’s decisions. He emphasized the need to amend the Penal Code in the field of hate speech, which is aimed at better protection of LGBT+ people. Godek, however, claims that she was the victim of unfair treatment.
The whole case highlights tensions in Polish society regarding the rights of LGBT+ people. Court decisions and reactions of both sides show how deep the divisions are and how difficult it is to reach an agreement.
