On August 11, 2021, an amendment to the Broadcasting Act was passed. It imposed an obligation to report certain services to the lists kept by the chairman of the National Broadcasting Council. This concerns entities providing audiovisual media services on demand (VOD) and video sharing platform providers (VSP) operating on November 1, 2021 (entry into force of the amendment).
The National Broadcasting Council collected a fine from the YouTuber. A considerable amount
“The above obligation applies to every person who publishes video materials on video-sharing platforms – YouTube, TikTok, Twitch, Facebook, etc. (i.e. records videos, video blogs or other video materials) and earns money from the service, e.g. on the basis of appropriate contracts with advertisers or representative of the platform,” explained Teresa BrykczyĆska, spokeswoman for the National Broadcasting Council, quoted by Wirtualne Media. Creators who earn less than PLN 1,505 gross per month are exempt from the obligation.
One of the YouTubers did not follow the recommendations. “Verification of the on-demand audiovisual media service provided by the influencer on the YouTube platform as part of her business showed that it is subject to the regulations arising from the Broadcasting Act,” we read on the gov.pl website.
The YouTuber did not react to the warning
The creator failed to fulfill this obligation and did not respond to the reminder sent in March 2024. Therefore, on November 30, a decision was issued imposing a fine of PLN 10,000 on the service provider. The amount was recovered by the Tax Office together with interest and reminder costs. The YouTuber’s details have not been disclosed.
