Mariusz Kamiński and Maciej Wąsik have been in prison for over a week. Meanwhile, the president has already presented at least three options regarding the acquittal of convicted criminals and former MPs. First, he claimed that his earlier pardon from 2015 was still valid, so former MPs pardoned before the verdict could not be sentenced because – that’s right – they had already been pardoned. After detaining Kamiński and Wąsik and transporting them to prisons, the president claimed that he was starting one of the longer pardon procedures, which requires, among other things, activities of the Prosecutor General’s Office and the Minister of Justice. After a few days, he stated that he could finally pardon the convicts again (?) using the shortest possible path, which his office denied after a few hours.

The president recently initiated the procedure for pardoning Mariusz Kamiński and Maciej Wąsik based on the Code of Criminal Procedure. Nothing changes in this respect. The president is waiting for the opinion of the prosecutor general regarding the pardon, because these are the requirements for this legal path – said Mastalerek in an interview with Onet.
What were Mariusz Kamiński and Maciej Wąsik convicted of?
Contrary to the opinion repeated by PiS politicians and the president himself, Mariusz Kamiński and Maciej Wąsik were not sentenced in a final judgment for “fighting corruption”. Wąsik and Kamiński exceeded their powers and ordered the forgery of a number of documents, they also tried to obtain false certification.. As the heads of the CBA (Wąsik was Kamiński’s deputy), in 2007 they ordered a provocation, aimed mainly at Andrzej Lepper, then Minister of Agriculture in the PiS government.
In 2009, they were charged with exceeding their powers and committing crimes against the credibility of documents. The use of provocation with the use of false documents, as well as the ordering of wiretapping in hotel rooms without the consent of the prosecutor general and the court were allegedly unlawful. Only on December 20, 2023, a final judgment was issued by the district court, which found Kamiński and Wąsik guilty. They were sentenced to two years’ imprisonment and banned from holding public positions for five years. The president is of the opinion that his 2015 pardon, granted to innocent politicians at that time, is also valid after a guilty verdict has been passed.. Some lawyers believe that such a “blank” pardon could lead to the degradation of the justice system by granting “in stock” pardons.
