According to the documents, the incident allegedly took place in August 2015, when the plaintiff was staying with a friend at the Catch NYC restaurant in New York. The plaintiff was 18 years old at the time and claims that she continues to suffer “physical and emotional trauma, anxiety, despair, shame and financial damage” as a result of the attack. The lawsuit also names the company that runs the New York restaurant and its co-founder, Mark Birnbaum, who the complainant said allegedly drank alcohol with Foxx at his table that night.
