The plaintiff was 18 years old at the time and claims that she continues to suffer “physical and emotional trauma, anxiety, despair, shame and financial damage” as a result of the attack. The lawsuit also names the company that runs the New York restaurant and its co-founder, Mark Birnbaum, who the complainant said allegedly drank alcohol with Foxx at his table that night.
