Most of them are monitored, which makes it easier to decide who will be responsible for the damage. If the product is damaged due to incorrect positioning on the shelf, you will not have to pay for it. According to the Civil Code, “the seller is obliged to provide appropriate technical and organizational conditions at the point of sale to enable selection of the sold item and checking its quality, completeness and functioning of the main mechanisms and basic components.” This applies, for example, to situations when you grab a product and, as a result, other things fall off the shelves.
The child destroyed goods in the store. Do you have to pay for it?
The situation is different when the goods were damaged due to your fault, e.g. you squeezed something too hard or you were not careful when putting items into the basket. According to the Civil Code, “whoever, through his fault, has caused damage to another person, is obliged to repair it.” So you have to pay for the damaged item. However, there is an exception: if the goods damage a child under 13 years of age, the child is not responsible for it. This is what the Civil Code says. However, the guardian must then demonstrate that he or she took proper care of the minor. An adult who intentionally destroys goods may be subject to a fine, restriction of liberty or arrest.
