Ticket machines were supposed to make paying fares easier, but we all know that sometimes the machines break down. What to do in such a situation? If we can’t pay the fare, do we have to get out of the vehicle? A trial took place in a Krakow court between the carrier and the carrier. The woman couldn’t buy a ticket from the machine because it couldn’t process the transaction. At the stop, the controllers got on and told her to go back to the terminus and demanded that she pay for the ride. Is it legal?

In an interview with “”, attorney Joanna Składowska argues that if a passenger is not able to purchase a ticket, he cannot be forced to leave the vehicle at a stop other than the one he has chosen. There is also no obligation to pay the fee in any other way, e.g. by purchasing a ticket on a smartphone, because no passenger is required to have a phone or a dedicated application. — The carrier is an entrepreneur and the passenger is a consumer. The consequences of a ticket machine failure cannot be borne by the passenger and as such they constitute a risk to the entrepreneur’s business activity, the lawyer explained. Please remember, however, that if we have the opportunity to buy a ticket and do not buy it, we may face a fine ranging from PLN 100 to PLN 300 – depending on the carrier’s price list.
