When tidying up the garden for autumn or spring, we often wonder whether the leaves, grass and branches collected then, i.e. the so-called green waste, we can burn it ourselves. The seemingly easiest method may turn out to be extremely expensive.

Can you burn branches, leaves, weeds and grass in the garden? The law is clear
Pursuant to the Waste Act of December 14, more precisely, the processing of waste, including branches, outside the devices intended for this purpose, is prohibited. This means that burning green waste in the garden on your own is against the law and we can do so. This is even more so when the smoke rising from the fire is additionally treated as disturbing public peace (immission, i.e. the so-called nuisance behavior).
The ban on burning green waste applies primarily to municipalities that conduct selective waste collection. If such a point is not provided, you can dispose of leaves and branches by burning, as long as you do it in a controlled manner and without violating other regulations (e.g. where exactly the places where you can light a fire are specified).
What to do with green waste? You can take them to a collection point or use them for composting
If there is a ban on burning green waste in a commune, it means that there is a local Selective Collection Point for Municipal Waste and this is where it should be delivered. Regular collections are often held right from home. Then all you have to do is put them in designated bags and put them under the fence, and the commune will take care of the rest. In addition, it is worth knowing that, according to the law, you can compost green waste.
If you don’t have a special container, you can buy bags with holes (or prepare them yourself) and carry out the entire process in them. Because it is time-consuming (it takes up to a year), it is worth adding a biopreparation containing bacteria and enzymes that will accelerate decomposition. You can also use the leaves to protect plants for the winter or prepare a bed for hedgehogs. These are simple and inexpensive ways to dispose of green waste legally and without fear of fines.
