When do grandparents pay child support for their grandchildren? One of three conditions is taken into account
As we can read in art. family and care, grandparents are obliged to contribute to their grandchildren in three cases. These are situations where:
- there is no person liable in a closer order (e.g. parents are deceased),
- the person is unable to fulfill his/her obligation to support the children,
- obtaining funds from her to support the child is impossible or involves excessive difficulties (e.g. due to lack of contact).
When one of the parents is dead, the obligation to support the child rests entirely with the other parent, but he or she is not always able to fulfill it, for example due to illness or other life situation. It may also happen that the enforcement of awarded alimony is impossible because the parent is serving a prison sentence or his place of residence is unknown. Only after one of the above conditions is met and proven can this obligation be transferred to the child’s grandparents.
What conditions still need to be met? There are two issues involved
However, these are not all the criteria that must be met for grandparents to be obliged to pay alimony. In addition to the above, they should be in need, and the seniors themselves should have adequate funds that will allow them to pay their debts. If they have difficulty making ends meet, there is no way for them to contribute additionally to their grandchildren. Importantly, the regulations do not regulate which grandparents should be obliged to pay alimony for their grandchildren first.
How to receive alimony from grandparents? How much can they be?
To apply for alimony from grandparents, you must submit a lawsuit to the District Court and attach documents confirming that the parent is unable to support the child. In addition, it is also worth pointing out that grandparents have appropriate resources. How much can they be? Their amount depends on the child’s needs (food, education, clothes, treatment, interests, etc.) and, of course, the financial resources of the grandparents. This means that there are no rigid amounts that you are entitled to in such a situation, because each of them is different and considered individually.
