Virtually every donation, in order to be valid, should be written down – preferably in the form of a notarial deed. The recipient is obliged to report it to the tax office and, if necessary, pay the amount due. Withdrawal of a donation is possible, but only in certain cases. This applies to both made and unmade donations. What are the grounds for recovering donated goods? We give you a hint.
Can I claim a donation back? Pay attention to these premises
In the case of an unfulfilled donation, it may be withdrawn if the donor’s financial situation has significantly and suddenly deteriorated and he is able to demonstrate this. These include, for example, a sudden loss of job, an accident, an unexpected illness, etc.
In a donation made, it can be withdrawn even after many years. In this case, it must be proven that the recipient has committed gross ingratitude towards the donor. If there is evidence, an application must be made to the court within one year of learning about gross ingratitude. Acting later will not bring results – both failure to meet the deadline and the inability to prove gross ingratitude will likely result in the court rejecting the application. If the donor forgives the recipient, the court will also take this into account and is unlikely to agree to withdraw the donation.
