Alternating care is gaining popularity in Poland, although there is no official definition of it in the Family and Care Code yet. However, this does not prevent separating parents and family courts from being more willing to choose this form of custody of their children. It is worth remembering that alternating care can be used not only after, but also during separation. What is it all about? Parents look after their children on set dates that last the same long period for each of them. It may look like the mother takes care of the children for two weeks, and the children stay with their father for the next two weeks.
Alternating custody and alimony. What might this look like in practice?
What does the situation look like in the case of alternating care? Two solutions are often used here. It sometimes happens that the court decides to abolish the maintenance obligation in such an arrangement. If the parents have equal custody of the children and live in a similar situation, then alimony may not be awarded. The situation is slightly different when, despite equal care for their children, parents do not live at similar levels. When one of them earns much more than the other, the court may order alimony, which would equalize conditions so that the child does not feel any difference when staying with each parent.
