The bridging pension is a benefit granted until reaching the standard retirement age. Then the senior can use the pension earlier. One of the main conditions entitling to receive it was work in special conditions or of a special nature before 1 January 1999. However, it was decided to abandon such a provision in , because it does not respond to the current needs of society.
The justification for the project states that technological progress has not significantly eliminated harmful working conditions, which is why it was decided to change the provision. It was recognized that the requirement of work in special conditions or in a special character, performed before 1 January 1999, would no longer be required for the award of the benefit.
Bridging Pensions Act – changes are coming. What else do they assume?
It turns out that the changes also concern the issue of compensation, i.e. compensation for the loss of the right to early retirement due to work in special conditions or of a special nature. So far, there is a provision which says that the period of work that entitles to the determination of compensation is to fall on the date before 1 January 2009.. It is also to be abolished in the amendment.
The authors of the draft amendment to the Act on bridging pensions also looked at the issue of circumvention of the law when granting . Trade union organizations signaled that some of them, receiving a bridging pension, additionally supplemented their household budget on the basis of a contract of mandate. In the current form of the Act, it only states that the bridging pension is received at the moment of starting the employment relationship, therefore ZUS did not suspend the old-age pension while performing it on the basis of civil law contracts.
