Flowers on the balcony are a popular solution that undoubtedly adds charm to the outside space. Some also grow balcony fruits, vegetables and herbs. Colorful pots decorate the railings and often delight passers-by. So why can you get a fine for hanging them? In some cases, they can be a serious threat to health and even life.

A fine for hanging pots on the balcony?

First of all, if we hang pots on the railing, its content should be directed to the inside of the balcony. If it’s outside, it’s easy to get into an accident. A heavy pot can fall and cause a tragedy. If an accident occurs, the owner of the apartment is liable to imprisonment for up to three years. It also happens that a pot will cause material damage if, for example, it falls on a neighbor’s balcony. The consequences are mentioned in art. 75 § 1 of the Code of Offenses.

Anyone who, without due care, exposes or hangs heavy objects or throws them, pours liquids, throws away impurities or causes such objects to fall out or spill liquids, is subject to a fine of up to PLN 500 or a reprimand.

If the pot hits a car parked in front of the block, the owner of the apartment may be held responsible for property damage. And when it falls in front of a passerby, it can be considered as exposing a person to danger, which, according to Art. 160 § 3 may result in a fine, restriction or imprisonment.
