The rapper plagiarized Gosia Andrzejewicz? The singer talks about legal action

Oliwka Brazil in her latest single was strongly inspired by the once popular song of Gosia Andrzejewicz “Let me live”. The singer commented on the whole situation, saying that she did not agree to cooperate, and despite this, the rapper used a sample from her song. Will the case end up in court?

Another scandal involving Oliwka Brazil was only a matter of time. Several days ago, she released the song “I’ve had enough”, which sounds deceptively similar to the song “Let live” by Gosia Andrzejewicz, loved in the 00’s. It turned out that the rapper used a sample of a famous hit without the consent of the singer or her label.

Oliwka Brazil did not receive permission to use Gosia Andrzejewicz’s work

DJ Remo, who heads the MyMusic record company, which released Gosia Andrzejewicz’s song years ago, wrote on Instagram that some time ago people from Warner Music Poland, which releases the music of Oliwka Brazil, contacted him, asking for permission to use the sample ” Let live”. Remigiusz Łupicki confessed that they did not agree to it, and the song was created anyway, so now they decide to check whether legal action can be taken:

We will let the lawyers evaluate it, but it was done very skilfully, so that from the legal point of view, there may be nothing to fear for it – for such borrowing, inspiration. (…)

Oliwka Brazil, on the other hand, referred to the whole situation, claiming that the elements of “Let live” were used in accordance with the law, referring to “follow up”, i.e. a loose paraphrase, conscious inspiration or reinterpretation.

Gosia Andrzejewicz refers to the scandal involving her work

The author of “Let live” initially did not speak on this matter, but a few days ago she decided to give an interview in which she told what she thought about the drama with Olive Brazil. She also confessed that she had previously thought about refreshing her hit from years ago:

Initially, I expressed interest in the idea because I liked the productions of this producer. At this point, it is worth noting that a few months earlier I had talked to Remik about preparing a new version of the song “Let Live” for the 20th anniversary of my career.

However, the singer decided to consult the whole matter with DJ Remo beforehand. He suggested to her not to agree to this cooperation, showing her the work of a young rapper, who both did not like. “At that moment, we had no doubts that we did not want this cooperation” – said Andrzejewicz.

The singer said that the head of MyMusic communicated this to people from Warner Music Poland. After the song Oliwka Brazil came to light, they decided together that they would try to draw legal consequences, but Andrzejewicz realizes that it may not be that simple:

However, it is difficult for me to comment on the appropriateness of our claims. At the first glance of the ear, there is no doubt – both the melody line and the text have been used. On the other hand, nowadays there is talk among artists about the “follow up” phenomenon. So it’s like a reference to my song. Anyway, even in the clip, similar scenes are used as in »Let live«. It is difficult for me to classify it unequivocally and this is what lawyers from MyMusic are dealing with.
