The obligation to have energy performance certificates will come into force soon. Failure to provide the appropriate document when selling or renting can result in severe penalties. However, the owners of the buildings have found a way to avoid fines and… they assemble shrines or statues of Mary.

From April 28, 2023 every person who rents or sells an apartment or a house will have to have an energy performance certificate. In the case of newly built houses, a certificate will be required when the buildings are handed over. For the lack of a certificate, there is a fine of up to PLN 5,000. Property owners, however, found a way to avoid it. The law left them free.

The amendment to the act introduces exceptions. Among them you can find e.g. places of worship and religious activity. However, there is no clear definition of such buildings. Religious figurines, e.g. of Mary, shrines, saints or crosses, are placed next to houses, blocks of flats or tenement houses. is so imprecise that a figurine and a notarial statement about the use of part of the building as a place of worship may be enough to be exempted from the need to have an energy certificate.

Energy certificate 2023. How much does it cost to obtain?

For the lack of an energy performance certificate, owners of houses and residential buildings will have to pay a fine of up to PLN 5,000. This also applies to older properties that are about to be sold or rented out. Depending on the size of the building or town, the cost of obtaining such a benefit may range from PLN 500 to PLN 1,500. This obligation also applies to apartment owners. The energy performance certificate will be necessary when signing a lease or sale agreement after April 28, 2023. Apart from places of worship, there are also:

  • industrial and utility buildings not equipped with energy-consuming installations,
  • buildings intended for use for 4 months a year,
  • detached buildings with a usable area of ​​less than 50 square meters.
