Until when can trees be cut down? Consider the autumn-winter period
As we can read in the minister’s document on the protection of animal species, on March 1, the breeding season of birds begins, which lasts until October. As a rule, cutting down trees during this time is prohibited. This means that it can legally last from October 16 to the end of Februaryunless previously authorized. As we can read on:
If the removal of a tree or shrub does not violate the prohibitions against protected species, they may also be removed during the breeding season of most bird species, i.e. from March 1 to October 15.
In this case, an appropriate permit must be issued from the regional director for environmental protection or the General Director for Environmental Protection.
The amount of the fine for felling trees without permission or consent of the owner depends on, among others: on the species or thickness of the tree trunk. It is twice the fee for removing the tree according to the law. This, in turn, is calculated by multiplying the circumference of the trunk at a height of 130 cm by the rate in accordance with . It must be paid within 14 days. It can amount to several thousand zlotys.
Can you cut down trees on your own property? It all depends on several factors
When do you need a permit to cut or cut a bush from your property? As stated:
- when the tree trunk is not the right thickness,
- when shrubs do not occupy a specific area,
- when the plot from which you want to remove a tree or shrubs is owned by a natural person, and their cutting is not related to running a business (e.g. you do not want to sell them later). In that case, you must declare your intention.
As for the trunk thickness mentioned earlier, it is enough to measure the circumference at a height of 5 cm from the ground. If it does not exceed specific dimensions, no permit is needed. In case of:
- poplar, willow, ash maple and silver maple is it up to 80 cm.
- horse chestnut, black locust and London plane tree it is up to 65 cm.
- of other tree species is this up to 50 cm.
As for shrubs, when the area they occupy does not exceed 25 m², a permit is not needed. You also don’t need to apply for a permit for broken or fallen trees, e.g. following a storm or accident.
It is worth knowing that on January 27, 2023, they entered into force concerning the issue of permits for the removal of a tree or shrub. Now you can submit your application in paper and electronic form. All deadlines have also been significantly shortened.
