Barbara Kurdej-Szatan heard allegations in connection with her entry on the activities of the Border Guard on the Polish-Belarusian border in mid-May. And in June 2022, the District Prosecutor’s Office in Warsaw filed an indictment against her.

At the beginning of December 2022, the District Court in Pruszków discontinued the proceedings against the accused artist, recognizing that the alleged act did not contain the hallmarks of a prohibited act. The decision was invalid. The parties were entitled to appeal to the Appeals Department of the District Court in Warsaw.
The Polish Press Agency reports that it has been informed by the District Prosecutor’s Office in Warsaw that it does not agree with the court’s decision and the reasoning adopted in the justification of the decision. “In the opinion of the public prosecutor, the publication of an entry in which the defendant uses the terms “machines without a brain and heart” and “murderers” in relation to the Border Guard and its officers performing statutory duties in the field of protection of the Polish border in the Polish-Belarusian section defamed the entity obliged to protection of state borders, as well as its officers.
She also pointed out that the quoted statement did not fall within the limits of freedom of speech. “The fact that it was emotional does not affect the assessment of the features of the alleged act” – said the prosecutor’s office. She also informed that she would immediately appeal against the issued decision, demanding its annulment.
According to the Polish Press Agency, the District Court in Warsaw upheld the appealed decision of the District Court in Pruszków. This means that the judgment is final.
The indictment concerned Barbara Kurdej-Szatan’s post on Instagram, in which she commented on the situation on the Polish-Belarusian border in an emotional and vulgar manner, where a humanitarian crisis was underway. Shortly after the publication, the actress issued a statement in connection with her statement about the Border Guard. She presented her position and indicated that she apologized to the representatives of the Border Guard.
However, the actress heard allegations in this case in mid-May. “The suspect did not admit to the alleged act and made extensive explanations” – the spokeswoman for the District Prosecutor’s Office in Warsaw reported.
