More and more people have a problem with documenting their work experience in ZUS. This is evidenced by the numerous complaints that come to the office of the Ombudsman. The private companies that deal with their storage are to blame. The lack of specific regulations in this area guarantees them impunity.
More and more people have trouble recovering their documents. Even years are waiting for them
The problem with recovering documents from companies that no longer exist, which are stored in private archives, is getting bigger and bigger. The certificate is required to prove employment before 1999, when the workplace employed over 20 insured persons. – People wait months or even years for copies of these documents – explains Mirosław Wróblewski, director of the Constitutional, International and EU Law Unit at the Office of the Commissioner for Human Rights, in an interview with us. An example is the situation of a woman from Gdańsk who received her documents only after two years. There were over 150 people in a similar situation from Gdańsk alone. The problem is nationwide.
Officials of the Commissioner for Human Rights argue that for years they have been trying unsuccessfully to intervene in the government to address the issue. The lack of specific regulations means that private archives can count on impunity. Not only do they store documents poorly, but they are also located in inappropriate places, such as basements, which often makes papers wet and even moldy. What’s more, there are no regulations that would specify the deadline for reviewing requests for access to documents or forcing archives to digitize them. There are only fees for issuing a duplicate in the amount of PLN 200 maximum.
What if your documents are lost? You have several options
If you do not provide all the documents to the -u, because e.g. they have been destroyed, it is assumed that the contribution was paid in the amount of the minimum wage. This means that some will receive less benefits than they are actually entitled to. Unfortunately, the lack of confirmation of employment also means that a given period is not included in the length of service. If this happens, the senior still has the opportunity to submit residual documentation to ZUS, i.e.:
- job contract
- changes in wage rates
- testimonies of witnesses, preferably former colleagues,
- entry in the insurance card or entry in the “old” ID card.
According to money.pl, the Minister of Family and Social Policy will discuss the problem in mid-February.
