Three members of Telewizja Polska’s program board filed a complaint against the release of “Wiadomości” on March 16, 2022. They accused the program of actions that infringe the Polish raison d’etat, hate speech towards Donald Tusk and the scandalous title of the material: “EPP – Putin’s European Party”. It is worth mentioning that at that time the politician was the chairman of the EPP (European People’s Party), which includes several dozen political parties in the European Union countries and many important EU politicians.
The complaint is not answered by the National Council, but by the head of TAI
The complaint was filed by Iwona Śledzińska-Katarasińska, Janusz Daszczyński and Krzysztof Luft. However, they certainly did not expect the answer they got. On Monday, the chairman of the National Broadcasting Council, Witold Kołodziejski, sent it. However, instead of the regulator’s position, it contains the “sender’s read request” that the National Council already received in May.
Jarosław Olechowski, the director of the Television Information Agency, also referred to the complaint. He explained that “the beam referred to the content of the material that referred to pro-Russian ties and the behavior of Donald Tusk, who currently heads the European People’s Party”.
“The material entitled EPP-Putin’s European Party informed about the support given by Donald Tusk to the anti-government opposition in Hungary, some of which were famous for their extremely anti-European views” – explained Jarosław Olechowski. “The material informed about the pro-Russian ties of politicians of the party, which is currently supported by Donald Tusk in Hungary, and also indicated Tusk’s support for pro-Russian politicians,” argued the head of TAI.
“We find no grounds to share the position with the applicants, and their subjective assessment is unfounded,” admitted Director Olechowski.
KRRiT like a postman
One of the authors of the complaint – Krzysztof Luft decided to reply to the National Council on the reply sent.
“The sender’s rejection of the allegations contained in the complaints is nothing unexpected, therefore such a reply from the sender is not a surprise to me, but it does not change in the least our negative assessment of the indicated broadcast in terms of compliance with the provisions of the act. of the proceeding in this case (as in any proceeding concerning complaints), the assessment made by the National Broadcasting Council and its Chairman is important. And we are still waiting for this answer from Mr. Chairman, “wrote Krzysztof Luft.
– This is an astonishing answer, because not the broadcaster, but the regulator which is the National Broadcasting Council, has the competence to settle the legitimacy of complaints about broadcasters – Krzysztof Luft comments for “Presserwis”. – This is reminiscent of a situation in which the merits of the accusation would be decided not by the court, but by the accused. The National Broadcasting Council is obliged to ensure that the act is not violated by broadcasters and is obliged to adjudicate in cases of signals about possible violations. Here, the role of a constitutional body was reduced to that of a postman, transmitting correspondence between viewers and broadcasters – additionally with a four-month delay – believes Luft.
