Do you want to sell a part of your house or distribute it among your children? So, the first thing you should do is divide your property into two or more independent properties, so that each of them has its own registry item. The subdivision procedure is carried out before the municipality of the district where the property is located and is registered in the National Superintendency of Public Registries (Sunarp) through the registration act of independence.
According to data provided by Sunarp, in recent years, more Peruvians have chosen to make their properties independent through subdivision. Only between January and May of this year, 12,964 separations were processed at the national level, which represented 2.95% more than the separations registered in the same period of 2021, when it reached 12,593.
In what corresponds to the geographical location, Lima, with 2,567 separations registered so far this year, was the most active region. It was followed by Puno (2,326), Cusco (987), San Martín (947), Junín (919), Ica (578), Lambayeque (576), Arequipa (544), Cajamarca (527), Apurímac (474), La Libertad (407), Huánuco (340), Ayacucho (337), Áncash (258), among others.
What are the requirements needed for the independence process?
The independence of an urban property, with or without a building, is made by presenting:
- Unique urban authorization form (FUHU), annex F, the municipal subdivision plan and a plan duly stamped and endorsed in which the area, boundaries and perimeter measurements of each of the resulting properties must be specified.
- Plans and cadastral reference code of the resulting properties issued by the respective municipality. If the municipality does not have an implemented cadastre, it presents a negative record of it.
- Private document with notarized certified signatures evidencing the consent of the co-owners who had not been involved in the subdivision process, in the case of co-ownership.
- Title registration application (free distribution form) duly filled out and signed by the applicant (person who carries out the process at Sunarp).
- Registration fee payment: S/ 89 for each area that becomes independent.
The qualification period is seven business days, counted from the day after the presentation.
